If I don’t repay an overpayment of Child Benefit, can the CB Office stop my husband’s Incapacity Benefit?
If I don't repay an overpayment of Child Benefit as I've been asked, and I can't manage to get the decision changed, are the Child Benefit office able to take the money out of my husband's benefits - Incapacity Benefit (for himself only), Housing Benefit and Council Tax Benefit?

No, they will just stop your child benefit – they are bastards – but not that inhumane – they would get sued.

They can do whatever they please!
If you have to pay back, it is best to come an agreement on a weekly payment that you can afford, if you argue they will decide how much!
Best to work with them rather than against them!

no they will cut the benefit,so you repay the outstanding balance back – i.e 5 pound a week etc.

Yes and they can take you to court which can result in a fine and a criminal record, they can also stop his benefit as a result so it is not worth the risk.
